A lawsuit has been filed against Publix for unpaid overtime. The suit contends that Publix failed to pay overtime wages on the quarterly and year end bonuses earned by department managers and assistant managers.
The suit also contends that Publix should have paid employees "time and one-half" overtime; rather than "half-time" under Publix's fluctuating work week (Chinese Overtime) method.
This suit is a "collective action" where other department managers and assistant managers who want to join, may do so. This action may include department managers and assistant managers from Florida, Georgia, Alabama, South Carolina, and Tennessee.

1. Worked as a Publix department manager or assistant manager within the past three years, and
2. Worked more than 40 hours in any week in the past 3 years; and
3. Been paid a quarterly bonus, or year-end bonus (Christmas bonus does not count);
4. Been paid on a fluctuating work week (Chinese Overtime) basis.
